Do I need an attorney?

How much is my case worth?

Every personal injury case is different. The answer to this question always boils down to damages. That is, determining what your injuries cost you mentally, physically and monetarily.

A damage award in an auto accident is either agreed upon in a negotiated settlement or it is ordered by a judge or jury after a trial.

How will my medical expenses get paid?

One of the most important things to do early on in a case is address the potential possibility of Medicare / Medicaid as well as any incurred medical bills to ensure that your credit isn’t damaged.  Many times we encounter cases where there is no health insurance or med-pay so the medical bills have to be reduced using the Missouri Hospital Lien statute.  When used correct, this statute ensures that all your medical bills get paid in full and that you still receive a monetary settlement regardless of the amount of the hospital lien(s).

How much does an attorney cost?

How long will my case take?

You have two choices on a personal injury case: 1. Settle; or 2. Go to trial. Naturally, settling a case without a lawsuit will be much faster than going to trial.  Most cases can be settled for a reasonable amount without incurring further time and expense.  Many cases at our firm settle 30-60 days after treatment is completed but others take much longer. 

How long the case will take depends on the circumstances. If the case involves a small amount of money, say, under $10,000, and the liability for the accident is clear, the case can be settled fairly quickly.

However, if there are legal or factual issues with the case (for example: if it involves a large amount of money, or if you may be partially at-fault) then the case can take longer. Also, if you have not yet reached maximum medical improvement, the case could take longer to settle.

Should I talk to the insurance adjuster?

No! This is one of the biggest mistakes people make following an accident. If you are in an accident and are contacted by the insurance company for the other driver, there is nothing that you can say to them that will help your case. They want to get a statement from you on the record and then will try to use it against you later to deny or reduce your claim. You should not speak to the insurance company without speaking to an experienced personal injury attorney first.

The insurance adjusters job is to settle your case for as little as possible. When people try to negotiate with insurance adjusters they often times get taken advantage of and end up settling for much less than their case is worth.  Don’t trust the insurance adjuster!

What three things should I do after an auto accident?

First, you should seek medical attention immediately. There are two reasons for this. First, your health is of paramount importance and you want to make sure your health needs are addressed right away. Second, if you are going to file a personal injury claim or lawsuit, you need to have your medical condition and injuries documented by a health care professional right away.

Creating a paper trail that documents your injuries and medical treatments right away will help to prove your case later and maximize your compensation. Do not delay in getting medical treatment!

Second, you should never admit any fault for an accident. Even if you think you may have been partially responsible, never admit this to anyone.

Third, if you have injuries and think that another party is at least partially at-fault, you should speak to an experienced personal injury attorney immediately. The more you try to handle on your own, the more you might say or do that can harm your case later on.

What if the at-fault driver has no insurance coverage?

All Missouri and Illinois drivers are required to carry minimum auto insurance coverage, but not everyone does.

If the driver who hit you does not have insurance, you can file a claim under your policy’s uninsured/underinsured motorist coverage. This can put you in the unusual situation of being pitted against your own insurance company. They may attempt to minimize coverage for your accident, just as the insurance company for another driver might do.

In this situation, it is usually a good idea to speak to a personal injury attorney to handle negotiations for the claim.

Note: if you are injured in a hit and run accident, this is considered an uninsured motorist claim.

Will my insurance sky rocket if I make a claim?

No! It is illegal for your insurance carrier to increase your rates if you are not at-fault in an accident.

How long do I have to file a personal injury claim?

Missouri law states that you have five (5) years to file your personal injury lawsuit and Illinois law states that you have only two (2) years, but you never want to wait that long to file a claim. Some cases require a good deal of discovery and preparation, so the sooner you contact an attorney to file the case, the better for you.
