“I cannot express how pleased I am with the results of my settlement after my auto accident last summer. I truly believe all the credit is due to Kevin Roach. Mr. Roach answered all my questions personally, whether it was in person or over the phone, and was quite knowledgeable in all phases of the auto claim. I was very pleased with the end result and the huge weight that was lifted off my shoulders after retaining Mr. Roach as my lawyer. I would absolutely give Mr. Roach the highest of recommendations.”

“I retained Kevin after the insurance company made a low ball offer on my auto accident claim. Kevin assured me that their offer was far below the value of my case and he was right on! My case ended up settling for more than five times what the insurance adjusted had originally offered. His staff was very pleasant to deal with and kevin was always available to answer questions. I would use him again if needed and would not hesitate to recommend his services to others.”

“Very good St. Louis attorney. Kevin represented me several years ago when I was injured an auto accident and he also represented my daughter. In both cases I was always kept up to date on what was going on. He is in court a lot but he always returns his calls. I would not hesitate to use him again.”

Frequently Asked Questions: Accident and Personal Injury Cases

Do I need an attorney?

Some accident victims are reluctant to hire an attorney because they think they cannot afford one. However, most personal injury attorneys, including Kevin Roach, are only paid if you receive a settlement or a verdict in your favor. You do not pay anything up front.

Also, remember that the statistics show that people who hire a personal injury attorney usually end up receiving far more accident compensation than if they handled the case on their own – as much as 40% more. The bottom line is - you will most likely receive more for your injuries by hiring an experienced and proven auto accident personal injury attorney.

Kevin Roach is one of those attorneys. He is a highly experienced and well-rated attorney who has practiced personal injury law since 2001. Kevin oversees every personal injury case to ensure that you receive the maximum financial award for your medical bills, lost wages, and pain & suffering.

How much is my case worth?

Every personal injury case is different. The answer to this question always boils down to damages. That is, determining what your injuries cost you mentally, physically and monetarily.

A damage award in an auto accident is either agreed upon in a negotiated settlement or it is ordered by a judge or jury after a trial.

The majority of personal injury damages are compensatory. They compensate you for what you lost due to your injuries. Some compensatory damages are simple to quantify, including:

  • Medical Costs
  • Lost Income
  • Property Losses

Others are harder to quantify and a figure is usually arrived at by using a multiplier based upon the above compensatory damages. Your attorney will refer to other similar accident cases in the recent past in your area, which will also provide an idea of how much to demand:

  • Pain and Suffering
  • Emotional Distress
  • Loss of Enjoyment of Life
  • Loss of Companionship or Consortium

If the defendant’s actions were truly reckless, you may also be entitled to punitive damages, which are intended to punish the defendant.

It is important to select a highly experienced and successful attorney who is able to fight for the maximum financial award. Attorneys such as Kevin Roach have years of experience in personal injury cases and will have a good idea of how much your case is worth, based upon your injuries and specific case circumstances.

How will my medical expenses get paid?

Medical expenses related to auto, truck, or motorcycle accidents are paid from many sources including the at-fault driver’s liability coverage, med-pay coverage, health insurance and Medicare/Medicaid. One of the most important things to do early on in a case is address the potential possibility of Medicare / Medicaid as well as any incurred medical bills to ensure that your credit isn’t damaged.  Many times we encounter cases where there is no health insurance or med-pay so the medical bills have to be reduced using the Missouri Hospital Lien statute.  When used correct, this statute ensures that all your medical bills get paid in full and that you still receive a monetary settlement regardless of the amount of the hospital lien(s).

Our firm deals with many cases that have medical bills far exceeding the insurance coverage and have been successful obtaining reductions while still securing our clients a monetary settlement.  We know that large medical bills can be worrisome and for that reason we offer a GUARANTEE that if we can’t get your medical bills/liens reduced and/or paid in-full, then we will reduce your attorney fees by $500.00

How much does an attorney cost?

Most personal injury attorneys, including Kevin Roach, work on a contingency basis. This means that he does not receive compensation unless you receive compensation. Kevin’s standard fee is 33% of whatever financial award you receive. He also has offers reduced attorney’s fees on auto and truck accidents starting at 25% of recovery.

What you need to remember is that filing a personal injury suit with Kevin will not cost you any money up front. You also stand to gain far more money by hiring an experienced personal injury attorney than if you try to do it alone.

How long will my case take?

If you have been injured in a car, truck, or motorcycle accident, you probably have injuries that require treatment. You might be losing wages as well due to the severity of these injuries. So, you obviously want to get your case settled as quickly as possible to receive the money you deserve.

You have two choices on a personal injury case: 1. Settle; or 2. Go to trial. Naturally, settling a case without a lawsuit will be much faster than going to trial.  Most cases can be settled for a reasonable amount without incurring further time and expense.  Many cases at our firm settle 30-60 days after treatment is completed but others take much longer.

How long the case will take depends on the circumstances. If the case involves a small amount of money, say, under $10,000, and the liability for the accident is clear, the case can be settled fairly quickly.

However, if there are legal or factual issues with the case (for example: if it involves a large amount of money, or if you may be partially at-fault) then the case can take longer. Also, if you have not yet reached maximum medical improvement, the case could take longer to settle.

Kevin Roach has the experience and knowledge about all types of accident cases to get your case settled as quickly as possible.

Should I talk to the insurance adjuster?

No! This is one of the biggest mistakes people make following an accident. If you are in an accident and are contacted by the insurance company for the other driver, there is nothing that you can say to them that will help your case. They want to get a statement from you on the record and then will try to use it against you later to deny or reduce your claim. You should not speak to the insurance company without speaking to an experienced personal injury attorney first.

The insurance adjusters job is to settle your case for as little as possible. When people try to negotiate with insurance adjusters they often times get taken advantage of and end up settling for much less than their case is worth.  Don’t trust the insurance adjuster!

What three things should I do after an auto accident?

First, you should seek medical attention immediately. There are two reasons for this. First, your health is of paramount importance and you want to make sure your health needs are addressed right away. Second, if you are going to file a personal injury claim or lawsuit, you need to have your medical condition and injuries documented by a health care professional right away.

Creating a paper trail that documents your injuries and medical treatments right away will help to prove your case later and maximize your compensation. Do not delay in getting medical treatment!

Second, you should never admit any fault for an accident. Even if you think you may have been partially responsible, never admit this to anyone.

Third, if you have injuries and think that another party is at least partially at-fault, you should speak to an experienced personal injury attorney immediately. The more you try to handle on your own, the more you might say or do that can harm your case later on.

What if the at-fault driver has no insurance coverage?

All Missouri and Illinois drivers are required to carry minimum auto insurance coverage, but not everyone does.

If the driver who hit you does not have insurance, you can file a claim under your policy’s uninsured/underinsured motorist coverage. This can put you in the unusual situation of being pitted against your own insurance company. They may attempt to minimize coverage for your accident, just as the insurance company for another driver might do.

In this situation, it is usually a good idea to speak to a personal injury attorney to handle negotiations for the claim.

Note: if you are injured in a hit and run accident, this is considered an uninsured motorist claim.

Will my insurance sky rocket if I make a claim?

No! It is illegal for your insurance carrier to increase your rates if you are not at-fault in an accident.

How long do I have to file a personal injury claim?

Missouri law states that you have five (5) years to file your personal injury lawsuit and Illinois law states that you have only two (2) years, but you never want to wait that long to file a claim. Some cases require a good deal of discovery and preparation, so the sooner you contact an attorney to file the case, the better for you.

If you still have questions about your car, truck, or motorcycle accident, please do not hesitate to contact Kevin Roach today for a free consultation.
